Abstract
In the Kalogeropoulou case, the ECHR decided once again in the context of a complaint relating to a foreign state, even if ius cogens has been violated. With the result the ECHR remains true to its jurisprudence. Although, state immunity is still an essential principle of customary international law, modifications according to the Court cannot be excluded for the future. Although welcome, such a modification of the principle would require the consent of the State community.
