    Abstract

    Based on a directive of the European Union in 2009, the liability of companies in the causation of environmental damage under Austrian law was revised. A major change arises in the strict liability (liability regardless of negligence or fault) for significant water damage as well as damage to the soil with considerable health risk. In addition, companies are now also responsible for damage to biodiversity. This paper highlights the possible consequences particularly for environmentally sensitive industries and discusses opportunities for risk reduction.
