Legal compliance in EMAS – Detecting environment-related hazards of the enterprise and avoiding liability

    Description

    The current environmental liability law of the federation and the provinces is designed as absolute liability which is irrespective of culpability. In the B-UHG two kinds of damages causing a liability are distinguished: considerable water contamination and soil contamination, which constitute a relevant risk for human health. The B-UHG imposes specific duties to act and duties to inform on plant operators. According to EMAS, the compliance with environmental laws is a first step to systematically avoid and reduce environmental-related hazards. Under EMAS, a risk avoidance which exceeds the environmental laws and regulations can only be reached by avoiding environmental burdens (annex I A. Abs. 2. lit. b EMAS-V) which includes obligatory identifying significant environmental aspects (Art. 2 Abs. f EMAS-V). It is assumed that the duties to act and to supply information under the B-UHG implicate no “new” requirements for EMAS companies.
